Before beginning a paid project, CreoLance Media and the client may
agree on matters including:
- Services to be provided
- Number and type of deliverables
- Project timeline
- Number of revisions
- Pricing and payment terms
- Required source materials
- Delivery format
- Other project-specific requirements
Project-specific proposals, quotations, invoices, statements of work,
written confirmations, or other written agreements may contain terms
that apply specifically to that project.
Where a project-specific written agreement conflicts with these
general Terms, the project-specific agreement will generally control
with respect to that project.
6. Client Responsibilities
The client is responsible for providing accurate, complete, and
timely information and materials necessary for the project.
The client is responsible for:
- Providing source footage, audio, images, logos, brand assets,
instructions, references, and other required materials. - Ensuring that materials supplied to CreoLance Media may legally be
used, edited, reproduced, and distributed for the intended project. - Providing clear feedback and approvals within reasonable timeframes.
- Reviewing deliverables and communicating required changes within
the agreed revision process. - Maintaining appropriate backups of original materials supplied to us.
7. Client-Provided Content and Rights
The client retains responsibility for the ownership and legal rights
associated with materials provided to CreoLance Media.
By providing content to us, you represent that you have the necessary
rights, permissions, licences, consents, and authority to allow
CreoLance Media to use that content for the agreed project.
This may include, where applicable, rights relating to video footage,
photographs, music, audio recordings, logos, trademarks, graphics,
third-party materials, and other intellectual property.
CreoLance Media is not responsible for claims arising from a client’s
failure to obtain appropriate rights or permissions for materials
supplied by the client.
8. Intellectual Property
8.1 Client Materials
Unless otherwise agreed in writing, intellectual property rights in
materials supplied by the client remain with the client or the
applicable rights holder.
8.2 CreoLance Media Materials
The Website, branding, logos, design elements, original graphics,
templates, workflows, processes, written content, and other materials
created or owned by CreoLance Media remain the property of CreoLance
Media or their respective rights holders unless otherwise agreed in
writing.
8.3 Final Deliverables
Ownership or licensing of final project deliverables will depend on
the agreement between CreoLance Media and the client.
Unless otherwise agreed in writing, payment for a project does not
automatically transfer ownership of CreoLance Media’s underlying
templates, editing systems, workflows, proprietary processes, or
pre-existing materials.
9. Portfolio and Promotional Use
Unless a client specifically requests otherwise in writing before
publication, CreoLance Media may display completed work or selected
portions of completed work in its portfolio, Website, social media,
presentations, case studies, or promotional materials.
This does not grant CreoLance Media ownership of the client’s
underlying intellectual property.
If a project is subject to confidentiality restrictions, a non-
disclosure agreement, or another written restriction that prohibits
promotional use, those restrictions will apply.
10. Pricing and Quotations
Prices displayed on the Website, if any, are for general information
and may not represent a final quotation for a particular project.
Final pricing may depend on factors such as project complexity,
quantity of content, duration of footage, editing requirements,
turnaround time, number of deliverables, revisions, and other
project-specific requirements.
A quotation or proposal issued by CreoLance Media may contain its own
validity period and conditions.
A project will generally begin after the applicable quotation,
proposal, or project terms have been accepted and any required
advance payment has been received.
11. Payments
Payment terms will be communicated to the client before or at the
beginning of a paid project.
Depending on the project, we may require an advance payment, milestone
payment, recurring payment, or full payment before delivery.
Unless otherwise agreed in writing, work may be paused if an invoice
or required payment remains overdue.
Additional work outside the agreed scope may result in additional
charges.
12. Revisions and Changes
The number of revisions included in a project will depend on the
applicable quotation, proposal, or project agreement.
A revision generally means a reasonable modification to an existing
deliverable based on the original project requirements.
Significant changes to the original brief, creative direction,
structure, format, or scope may be treated as additional work and
may incur additional charges.
Clients are encouraged to provide consolidated and clear feedback to
help maintain the agreed project timeline.
13. Project Timelines and Delays
We will make reasonable efforts to meet agreed project timelines.
However, timelines may depend on the timely receipt of source
materials, feedback, approvals, payments, and other information
from the client.
Delays caused by incomplete materials, delayed feedback, additional
revisions, changes in scope, technical issues, third-party services,
force majeure events, or circumstances outside our reasonable control
may affect the delivery date.
14. Cancellation and Termination
Either party may request cancellation or termination of a project,
subject to any project-specific agreement.
If a client cancels a project after work has started, the client may
remain responsible for payment for work already completed, approved
expenses, committed resources, and any other non-refundable amounts
agreed for the project.
CreoLance Media may suspend or terminate services where a client
materially breaches these Terms, fails to make required payments,
provides unlawful content, or engages in abusive, fraudulent, or
inappropriate conduct.
15. Refunds
Refund eligibility, if any, will depend on the nature of the service,
the stage of the project, payments already made, work completed, and
the applicable project agreement.
Where a project-specific agreement contains refund or cancellation
terms, those terms will apply to the relevant project.
No refund is guaranteed solely because a client changes their mind
after work has commenced or after agreed work has been completed.
16. Deliverables and Approval
Deliverables may be provided through email, cloud storage, file
transfer services, project management platforms, or other agreed
methods.
The client is responsible for reviewing delivered files and notifying
CreoLance Media of any issues or requested revisions within the
applicable revision period.
Once a deliverable has been approved or the applicable revision period
has expired, additional changes may be treated as new work and may
incur additional charges.
17. Content Performance and Results
CreoLance Media may provide creative recommendations intended to
improve the quality, presentation, or distribution potential of
content.
However, we do not guarantee specific results from published content,
including views, reach, engagement, followers, subscribers, leads,
sales, revenue, viral performance, rankings, or platform growth.
Content performance can be affected by factors outside our control,
including platform algorithms, audience behaviour, publishing
strategy, competition, timing, account history, and changes made by
third-party platforms.
18. Third-Party Platforms
Our services may involve or prepare content for third-party platforms
such as YouTube, Instagram, TikTok, Facebook, LinkedIn, or other
platforms.
CreoLance Media does not control third-party platforms and is not
responsible for changes to their policies, algorithms, features,
availability, moderation decisions, account restrictions, copyright
systems, or other platform actions.
Clients remain responsible for their own accounts and compliance with
the terms and policies of platforms on which they publish content.
19. Confidentiality
We understand that clients may provide confidential business,
creative, marketing, or other information during a project.
CreoLance Media will use reasonable measures to protect confidential
information provided for the purpose of performing services.

exists, the terms of that agreement will govern the confidential
information covered by it.

branding, graphics, text, design, layout, visual elements, logos,
and other materials are owned by or licensed to CreoLance Media.

license, or commercially exploit Website materials without prior
